要するに10月31日の仮差止め命令後は、特許庁に対する原告の開示要求をめぐるやりとりが中心に進められていたようです。内容は、特許庁が今回の規則を制定するに到った内部記録を開示するよう求めた原告のディスカバリー要求に対し、特許庁が秘匿特権を主張してこれを拒否。このやりとりにおいては、特許庁側の言い分が認められましたが、この命令を下したのは補助裁判官であり、原告側は正規裁判官に対し補助裁判官の命令を見直すよう請求してゆくようです。サマリー・ジャッジメントの申立てが12月20日までに提出されるか否かは、このあたりの動きにもよってくると思われます。今後、大きな進展がありましたら、引き続き本ウェブサイトでもご紹介してゆく予定です。
