本年9月1日より、米国特許庁は、登録商標について、登録されている指定商品・役務の記述ではカバーされなくなった指定商品・役務の自発補正を認めるパイロット・プログラムを実施しております。

この登録商標の指定商品・役務に関する自発補正は、消費者に販売又は提供されている特定の指定商品・役務に関し、その記述の根本的内容や主要部分が、技術革新によってもたらされた様態又は媒体の変化により、補正が必要と判断される場合に認められます。

但し、この自発補正は、技術革新により、登録されている指定商品・役務の記述では、もはや当該登録商標の使用を立証できない場合のみに認められます。もし、登録されている記述のままの指定商品・役務について当該登録商標の使用を継続できる場合であれば、進化した指定商品・役務に関しては、新規出願を行う必要があります。米国特許庁は、認可される自発補正として下記のような具体例を公表しています。

・phonograph records featuring music in class 9
　=> musical sound recordings in class 9

・prerecorded video cassettes in the field of mathematics instruction in class 9
　=> video recordings featuring mathematics instruction in class 9

・floppy discs for computers for word processing in class 9
　=> providing on-line non-downloadable software for word processing in class 42

・downloadable software for use in database management in class 9
　=> software as a service (SAAS) services featuring software for use in database management in class 42

・printed books in the field of art history in class 16
　=> downloadable electronic books in the field of art history in class 9

・telephone banking services in class 36
　=> on-line banking services in class 36

・entertainment services, namely, an ongoing comedy series provided through cable
television in class 41
　=> entertainment services, namely, an ongoing comedy series broadcast via the
Internet in class 41

尚、このパイロット・プログラムが実施される期間は、今のところ決められておらず、今後の自発補正申請の件数次第で決定されることになっています。
